MARKETING GUIDELINES
1.1 If you are participating in our media buying and/or the influencer/ambassador program, the term Counterparty in these Marketing Guidelines shall be read to include the term Partner or Ambassador (as the case may be).
1.2 The Counterparty hereby irrevocably agrees to adopt, be bound by and comply with the Marketing Guidelines at all times during the term of its agreement with the Company and/or during the business relationship under
any agreement concluded with you, and that it shall keep itself updated at all times with reference to any updates made against these Marketing Guidelines.
1.3 In these Marketing Guidelines, unless the context otherwise requires, expressions defined here, shall have the meaning set out in each of the Agreement entered into by you and the Company.
1.4 The Marketing Guidelines Options, Forex, Cryptocurrency and CFD trading is a regulated activity; as a consequence, all of the Counterparty's promotional materials must be fair, not misleading, clear, and comply with these Marketing Guidelines:
1.4.1 All statements must be balanced; therefore, if the Counterparty mentions potential profits, the Counterparty must always also mention potential losses. When promoting the Company , the Counterparty must not promise that one can learn trading easily or profitably with the Company unless the Counterparty is specifically referring to the demo account. The Counterparty must avoid using terms such as "win/make/earn money", "start your trading career", or "make an income", as well as other similar terms.
1.4.2 The Counterparty is not allowed to publish materials or use phrases stating that trading is easy and exciting. Additionally, implying that trading leads to success, a change in lifestyle, financial freedom or any other unwarranted benefit is prohibited. The Counterparty must not use any visual reference to money (cash, credit cards, notes and coins), with the exception of references regarding withdrawals.
1.4.3 Options, Forex, Cryptocurrency and CFDs are complex products and are not suitable for everyone. The Counterparty must ensure that its promotional materials do not imply that the Company 's products are
easy to understand/use and accessible to everyone.
1.4.4 The Counterparty should not advertise the Company as "work from home", "making easy/guaranteed money" or other unwarranted claims or misleading statements, as such promotion would not emphasize the high risk involved in trading Options, Forex, Cryptocurrency and CFDs, and would interfere with the integrity of the Company .
1.4.5 The Counterparty must submit to the Company the Channels, webpages, ad campaigns or other sources used to promote the Company as soon as possible and not later than a week from publication date.
1.4.6 The Company is registered in Antigua and Barbuda, it is not licensed by any regulatory body so at no point should you indicate that the Company is licensed and/or regulated in any way by any regulator and/or competent authority. Consequently when needed you should only mention that the Company is registered in Antigua and Barbuda.
1.4.7 The Company does not wish to be promoted on a Channel, website or a webpage that exclusively offers trading signals, social trading, copy-trading, auto-trading, robots, investment advice or portfolio management services. Whether the Company identifies such materials/sources, it shall notify the
Counterparty to remove such promotions as soon as possible.
1.4.8 In a case when a Facebook or another social network page (including YouTube) is used for promotion, such social network pages can be accepted as a traffic source only if these pages are not promoting the Company directly but instead promote a website which is used as a traffic source itself. An exception can be made on the Company 's behalf. You may use Facebook and other social network pages, by keeping a page of your own resource that is not similar to the resources of the Company , and by purchasing advertisements for this resource.
1.4.9 All promotions and invitations to open a trading account (registration links) must include risk warnings (RW) as below in a clear readable and visible form and in an appropriate font size:
a. The Counterparty can use a long risk warning on long materials such as landing page, website and in case it is visible in each screen of the page:
"General Risk Warning: The financial products offered by the company carry a high level of risk and can result in the loss of all your funds. You should never invest money that you cannot afford to lose"; or
b. The Counterparty can use a short risk warning for short materials (e.g. small banner, post on social network page..etc):
"RISK WARNING: YOUR CAPITAL MIGHT BE AT RISK " under each link or button to the Company together with a long Risk Warning at the end of the page or review.
a. The Counterparty should ensure the RW is clearly readable, visible and of appropriate size.
1.4.10 The Counterparty shall not refer to bonus as the company does not offer bonuses.
1.4.11 Whenever the Counterparty mentions a potential profitability percentage (payout), the Counterparty must always include an asterisk next to the percentage and add the following statement "*amount to be
credited to the account for a successful trade".
1.4.12 The Marketing Material and any other materials should not include information regarding strategies that indicate them as trading strategies (e.g. "the Martingale trading strategy"). Instead, if the Counterparty
uses the information based on strategies, the Counterparty should call it a "trading pattern" and such material should contain the following risk disclaimer: "Your capital may be at risk. This material is not
investment advice".
1.4.13 All videos must contain the following risk warning that is visible throughout the entire duration of the video: "RISK WARNING: YOUR CAPITAL MIGHT BE AT RISK". If the Counterparty is recording a trading session, the Counterparty should not use the word "strategy", the Counterparty should not give investment advice and add an additional warning: "NOTE: THIS VIDEO IS NOT AN INVESTMENT ADVICE".
1.4.14 Any risk warning should be in bold, not obscured by its color or tried to be hidden among pictures – a risk warning should be clearly legible to all clients/users/viewers/visitors and draw a reader's eye to it.
Moreover, a risk warning should be located not lower than where the legal/contact information is situated on the Channel.
1.4.15 The following practices are not tolerated for the Counterparty to provide a mean for direct communication: cold e-mailing; use of live chat; use of registration systems or feedback forms where an Counterparty would obtain a potential client's contact details; allowing prospective clients to contact the
Counterparty through an e-mail address noted on the Counterparty's website; cold calling; any other method of direct communication.
1.4.16 The Counterparty further irrevocably undertakes that at all times it shall:
a. clearly identify/indicate on the Channels, any web-sites and webpages that they are unofficial websites of the Company . This is to be clearly indicated on the first screen of the home page in a font that is not smaller than the main font of the page;
b. the Counterparty shall regularly update the Marketing Materials or replace them within a reasonable timeframe with up-to-date ones upon the request of the Company and/or upon they are changed/updated. However, the Company will require immediate assistance from the Counterparty to comply with critical regulatory requirements;
c. equally describe advantages and disadvantages of any financial instrument it may promote from time to time;
1.4.17 In case of comparison with another broker or service, use only true and accurate information and indicate reliable and up-to-date sources and information;
a. in case of describing any behavior of one financial instrument and/or underlying asset, indicate precise time of such described behavior and clearly define that such information belongs to the past and may not bring the same results in the present or the future; and
b. in case of using any information for forecasting future behavior of any financial instrument and/or underlying asset, at all times base such information exclusively on verified information and warn the users about the fact that such forecasts are not a reliable indicator nor do they in any way guarantee any profit.
1.4.18 The Counterparty shall not:
a. Use the the Company's brand for any unlawful activities, or having any content on his/her/its website, that is defamatory, violent, pornographic unlawful, threatening, obscene or racially, ethnically, or otherwise discriminatory or in breach of any third party rights and shall not link to
any such material; or violate any intellectual property or other proprietary rights of any third party or has defamatory or harassing and deceitful or untruthful comments and statements about the Company;
b. Use the practice of brand bidding;
c. The Company has no intention to attract traffic that is unrelated and/or is irrelevant to the Company, in particular, traffic in the following jurisdictions; US, Canada, United Kingdom, Australia, Belgium, Israel, Palestine, Japan, Syria, Iran, North Korea, the Russian Federation, Switzerland and/or any country of the European Economic Area. If the Company determines that
such unrelated traffic is being attracted, it shall notify the Counterparty to stop this traffic as soon as possible.
